BY PURCHASING A SUBSCRIPTION WITH OUR SHARMAFX FOREX MENTORSHIP PROGRAM, YOU ARE AGREEING TO THESE TERMS, OTHER METHODS OF ACCEPTANCE INCLUDE: EXECUTING A SALES ORDER OR OTHER DOCUMENT THAT REFERENCES THESE CONSUMER TERMS, OR BY DOWNLOADING, INSTALLING, OR OTHERWISE ACCESSING OR USING THE SERVICE, YOU AGREE THAT YOU HAVE READ AND UNDERSTOOD, AND, AS A CONDITION TO YOUR USE OF THE SERVICE, YOU AGREE TO BE BOUND BY THE FOLLOWING TERMS AND CONDITIONS. IF YOU ARE NOT ELIGIBLE, OR DO NOT AGREE TO THE TERMS, THEN YOU DO NOT HAVE OUR PERMISSION TO USE THE SERVICE. YOUR USE OF THE SERVICE, AND SHARMAFX PROVISION OF THE SERVICE TO YOU, CONSTITUTES AN AGREEMENT BY SHARMAFX AND BY YOU TO BE BOUND BY THESE TERMS.
1. Acceptance of Terms
Welcome to SharmaFX, also referred to as “SharmaFX Forex Mentorship Program”, ("we," "us," or "our"). By enrolling in our courses or using our services, you agree to comply with and be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.
2. Description of Services
We provide online education services focused on helping traders (“Students”) develop their own trading strategies in the foreign exchange market ("Services"). These Services include access to our live sessions via Zoom Communications, virtual communication via Discord, and any other platforms we may use to provide educational content subject to the terms outlined herein.
3. Service Rights And Restrictions
If an Order indicates that Customer will receive access to a Service, then Customer may access and use such Service solely (a) for the Order Term set forth in such Order, and (b) in accordance with all applicable Documentation (defined below) and the restrictions set forth in these Enterprise Terms (including the applicable Order).
Only the employees or contractors of Customer, that Customer allows to use the Service (“Users”), using the mechanisms designated by SharmaFX (“Log-in Credentials”), may access and use the Service, and only in the number set forth in the applicable Order. Each User must keep its Log-in Credentials confidential and not share them with anyone else. Customer is responsible for its Users’ compliance with these Enterprise Terms and all actions taken through their Log-in Credentials (excluding misuse of the Log-in Credentials caused by SharmaFX breach of these Enterprise Terms). Customer will promptly notify SharmaFX if it becomes aware of any compromise of any Log-in Credentials. SharmaFX may process Log-In Credentials in connection with SharmaFX provision of the Services or for SharmaFX internal business purposes.
3. Intellectual Property
a. Client's Intellectual Property: We respect and acknowledge that the intellectual property (IP) rights of our clients are their own property. During your participation in our programs and courses, you may share information related to your trade ideas, concepts, and projects. We agree not to disclose or use your IP outside the confines of our business relationship. Similarly, you agree not to disclose or use our proprietary course materials, methodologies, or processes outside the confines of our business relationship.
b. Public Community Chat: We offer a community chat platform where traders can engage in conversations at their own discretion ("Community Chat"). You are solely responsible for any information you choose to share in the Community Chat, and we do not assume any liability for such disclosures.
4. User Conduct
You agree to use our Services in compliance with all applicable laws and regulations. You shall not:
Violate the intellectual property rights of others.
Interfere with or disrupt the operation of our Services.
Transmit or distribute any harmful code, malware, or viruses.
Engage in any form of automated data collection or data scraping.
Violate the privacy of others or harvest or collect personally identifiable information without their consent.
5. Changes to Terms
We may update these Terms from time to time to reflect changes in our Services or for other operational, legal, or regulatory reasons. Any updates will be posted on our website, and the date of the latest revision will be indicated at the top of these Terms.
6. Severability
If any part of these Terms is found to be illegal, unenforceable, or invalid, the remaining portions of these Enterprise Terms will remain in full force and effect. If any material limitation or restriction on the use of the Service under these Enterprise Terms is found to be illegal, unenforceable, or invalid, Customer’s right to use the Service will immediately terminate.
7. Termination
We reserve the right to terminate or suspend your access to our Services, including Discord and other platforms we may use to provide education, at our discretion, without notice, for any violation of these Terms or for any other reason we deem necessary to protect our business and our community.
